The use of any BakPak™ products is considered acceptance of the terms and conditions.

1. Returns: Unused containers can be returned within 3 days of delivery. Customer must pay for return shipping and is not authorized to use the pre-paid return shipping label to do so. All returns can be sent to BakPak™ Returns, 250 Main Street, East Windsor, CT 06088.

2. NLR: NLR has made every effort to provide proper DOT compliant containers and packaging for shipping of used universal waste lamps, dry cell batteries, non-PCB ballasts, and electronics provided that the containers have been properly packed and sealed as per the enclosed instructions.
   
   All returned universal waste is guaranteed to be recycled in accordance with all applicable Federal and State RCRAA and Universal Waste laws.

3. Customer: The customer agrees to only ship the allowed Universal Waste as identified by BakPak™ products in their respective BakPak™ containers following all guidelines for packaging and final shipping. Quantities of waste may not exceed those as described in the packaging description.  All FedEx® pre-paid labels are only to be used for BakPak™ products.

4. Additional Charges: Additional fees will be incurred for: lamp waste that is not properly packaged in the innerliner as specified in the directions or if the waste exceeds the capacity as listed. NLR reserves the right to charge additional fees and/or refuse acceptance of the waste.

5. Disclaimer: NLR, Inc, shall not incur any liability incurred in connection with your use of the BakPak™ recycling program, and shall NOT under any circumstances extend to claims of special, incidental, or punitive damages derived from that use.

6. Indemnification: NLR, Inc  undertakes to indemnify you, your officers, agents and employees from any and all liability, loss, damage and expenses (including attorney fees) that may be suffered as the result of personal injury (including death) to any person or damage to property arising out of or connected with the proper and intended use of our BakPak™ recycling program as prescribed in the terms and conditions outlined above, or as the result of a violation of said terms and conditions by us; provided, however, that any such liability, loss or damage resulting from (I) a failure to adhere to the terms found in NLR, Inc written instructions relative to the proper and intended use of the BakPak™ recycling program, or (II) negligence or willful malfeasance, by you or your officers, agents and employees, is excluded from this agreement to indemnify, defend and hold harmless.

7. Accumulation Start Date: When using any BakPak™ recycling containers, the Accumulation Start Date (date waste collection begins) is to be written on the FedEx® return label in the given area. Ship the container within one year of the start date to comply with regulations.

8. Recycling Certificate: Recycling Certificates are issued once the universal waste is received and processed. Customer will receive a full Certificate that outlines the dates received, date processed and the quantity of the waste.
